By accessing Secret Stash or the Website or using the Services, you are you expressly (without any limitation or qualification) agreeing to the Terms of Use, Terms and Conditions and Privacy Policy. The term “you” “your” (or a similar reference) and “User” refers to the user of the Platform and the term “us” “our” “we” refers to the Operator (as defined in the Privacy Policy).

These Terms of Use shall govern and be applicable to and your use of it. It is important to note that these Terms of Use shall be deemed to apply to anyone viewing this Website and not only those that are using, browsing or registered Users on Secretstash.pk.

The Operator may add to or change or update these, from time to time entirely at its own discretion. The User must read these Terms of Use periodically or every time the User accesses the Platform to remain in compliance with these terms. The User’s use of Secret Stash after any amendment to the Terms of Use shall constitute the User’s acceptance of these Terms and Conditions as amended, revised or modified.

By accessing, downloading, copying, and/or using Secret Stash, including this Website, and/or the Services, you agree to these User Terms. THESE USER TERMS CREATE A BINDING LEGAL AGREEMENT BETWEEN YOU AND ALLSET AND INCLUDE AN ARBITRATION CLAUSE UNDER WHICH CERTAIN CLAIMS MAY NOT BE BROUGHT IN COURT. PLEASE READ THEM CAREFULLY. 

1. Definitions

1.1. When the following words are used in these Terms, this is what they will mean:

Brand New: The Product has never been used and there are no visible marks of wear. Sometimes may have a mark or two from storage and in some cases still, have original tags in place. 

Like New: The item may have been used once or twice and will have minimal signs of wear. 

Gently Used: The item is used but is in excellent condition and will have a few signs of wear that aren't very noticeable.

Pre-Loved: Item has been used and it shows signs of wear which we will clearly write.

Secret Stash Platform: The website www.secretstash.pk

Device: a User's mobile telephone, smartphone or handheld device.

Intellectual Property Rights: The term “Intellectual Property Rights” (hereinafter referred to as the ‘IP’) means all (i) patents, patent applications, patent disclosures and inventions, (ii) Internet Domain names, trademarks, service marks, trade dress, trade names, logos and corporate names and registrations and applications for registration thereof together with all of the goodwill associated therewith, (iii) copyrights (registered or unregistered) and copyrightable works and registrations and applications for registration thereof, (iv) mask works and registrations and applications thereof, (v) computer software, data, databases and documentation thereof, (vi) trade secrets and other confidential information (including ideas, formulas, compositions, inventions (whether patentable or unpatentable and whether or not reduced to practice), know-how, manufacturing and production processes and techniques, research and development information, drawings, specifications, designs, plans, proposals, technical data, and copyrightable works, financial and marketing plans and customer and supplier lists and information, and (vii) copies and tangible embodiments thereof (in whatever form or medium).

Secret Stash: Secret Stash, a registered company under the laws of the Islamic Republic of Pakistan.

Terms: the terms and conditions set out in this document.

User(s): customers (You) who sign up with Secret Stash, use the website or browse the website.

1.2. The words "writing" or "written" in these Terms will include e-mail unless specified otherwise.

1.3. These are the terms and conditions on which Secret Stash supplies the website to you.

1.4. By using the Platform you accept and agree to be bound by these Terms and the license contained within them, including the Secret Stash Privacy policy. We may at any time modify these Terms.

1.5. These Terms and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of Pakistan.

2. Using Our Services

2.1. You may use our Services only if you can form a binding and enforceable contract/agreement with Secret Stash, no use of the Services is permitted by those under the age of majority. In no event is the use of the Services permitted by those under the age of 18. If you are using the Services on behalf of any entity, then you are agreeing to the Terms of Use on behalf of that entity. Where you use the Service in the course of your employment or business, you enter into this Agreement both on your own behalf and in your individual capacity as an employee, officer, agent, partner, etc. of such organization which you represent, and references in this Agreement to "you" shall mean both you as the individual user of the Service and you in your capacity as a representative of your organization. Without prejudice to any other rights and remedies of Secret Stash under these Terms and Conditions or at law, Secret Stash reserves the right to limit or withdraw access to the Website or the registration of any person if Secret Stash believes that person is under the age of 18 years or is of unsound mind.

2.2. Using our Services does not give you ownership of any intellectual property rights in our Services or the content you access. Except in the context of browsing or accessing our Services in accordance with these Terms of Use, you may not use content from our Services unless you obtain permission from its owner or are otherwise permitted by law. These terms do not grant you the right to use any branding or logos used in our Services.

2.3. Submissions or opinions expressed on this platform are those of the individual posting such content and do not necessarily reflect our opinions. Certain services and related features that may be made available on the Website may require registration or subscription. Should you choose to register or subscribe for any such services or related features; you agree to provide accurate and current information about yourself, and to promptly update such information if there are any changes. Every user of Secret Stash is solely responsible for keeping passwords and other account identifiers safe and secure. The account owner is entirely responsible for all activities that occur under such password or account. Furthermore, you must notify us of any unauthorized use of your password or account. Secret Stash shall not be responsible or liable, directly or indirectly, in any way for any loss or damage of any kind incurred as a result of, or in connection with, your failure to comply with this section.

2.4. During the registration process, you agree to receive promotional emails from Secret Stash. You can subsequently opt out of receiving such promotional e-mails by clicking on the link at the bottom of any promotional email. 

3. User Eligibility and Website Access

3.1. Use of the Site is available only to persons who can form legally binding contracts under Pakistan Contract Act, 1872. Persons who are "incompetent to contract" within the meaning of the Pakistan Contract Act, 1872 including minors, un-discharged insolvents, of unsound mind are not eligible to use the Site. If you are a minor i.e. under the age of 18 years, you cannot register as a member of the Site and shall not purchase any items on the Site. As a minor, if you wish to purchase an item on the Site your legal guardian or parents who have registered as users of the Site may make such purchase or sale on your behalf. We reserve the right to terminate your membership and refuse to provide you with access to the Site if it is brought to our notice or if it is discovered that you are under the age of 18 years.

3.2. We grant you a limited license to access and make personal use of the Site and the Service. This license does not include any downloading or copying of account information for the benefit of another vendor or any other third party; caching, unauthorized hypertext links to the Site and the framing of any content available through the Site uploading, posting, or transmitting any content that you do not have a right to make available (such as the intellectual property of another party); uploading, posting, or transmitting any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment; any action that imposes or may impose (in our sole discretion) an unreasonable or disproportionately large load on our infrastructure; or any use of data mining, robots, or similar data gathering and extraction tools. You may not bypass any measures used by us to prevent or restrict access to the Site. Any unauthorized use by you shall terminate the permission or license granted to you by us.

4. Registration Information

4.1. Registering with Secret Stash will not be confirmed until the following information has been provided and verified:

4.1.1. – Valid E-mail (verified through e-mail);

4.2. Upon confirmation of the details in 4.1 above, Users will be connected to Secret Stash. If the email provided cannot be verified by Secret Stash, Secret Stash reserves the right to refuse the User access to the Website. 

5. Using Secret Stash

5.1. Secret Stash will supply the Services to you from the date that the details in Clause 4 are confirmed.

5.2. Secret Stash will make every effort to ensure the Platform is operational 24 hours a day, 7 days a week. However, there may be issues or delays due to events outside Secret Stash control.

5.3. Secret Stash may have to suspend the Platform if it has to deal with technical problems or to make improvements. Secret Stash will contact you to let you know in advance where this occurs unless the problem is urgent or an emergency. This does not affect your obligation to pay any outstanding amounts on any services you may have requested from Secret Stash (as may be notified to the Users by Secret Stash).

5.4. In the unlikely event that there is any defect with the Website:

- Please contact Secret Stash as soon as reasonably possible;

- Please give Secret Stash a reasonable opportunity to repair or fix any defect;

Secret Stash will use every effort to repair or fix the defect as soon as reasonably practicable. You will not have to pay for Secret Stash to repair or fix a defect with the Platform under this clause 5.4.

5.5. By using Secret Stash you warrant that:

- are capable of forming legally binding contracts;

- will not provide your Secret Stash credentials to any third party;

- will not use Secret Stash in a way that breaches these terms of use, any laws or infringes any rights of third parties;

- will not interfere with anyone else’s use of Secret Stash, including sending spam; and

- will not copy, scrape or reproduce content from Secret Stash one including information about third parties without their consent.

In consideration of the circumstances, and where We think it is reasonable to do so, We may suspend or terminate your access to Secret Stash and reserve the right to take any appropriate steps at law to protect Our interests or those of third parties.

6. Registration and Password

6.1. At the time of registration on the website, you will be able to generate a password and an account upon completing the Website's registration process. You are responsible for maintaining the confidentiality of the password and account and are fully responsible for all activities that occur under your password or account.

 6.2. You are responsible for maintaining the confidentiality of your account access information and passwords. You shall be responsible for all uses of your Website registrations and passwords, whether or not authorized by you. The log in information created for the purpose of accessing Secret Stash is to be used solely by the person who has registered with the Website. Secret Stash reserves the right to store the access information including the IP address of the computer/device from where the Website was accessed. You are not authorized to share your password or other account access information with any other party, temporarily or permanently, and breach of this obligation may tantamount to disabling the Secret Stash account at the sole discretion of Secret Stash and terminating the contract with You. You agree to:-

6.2.1.- immediately notify  Secret Stash of any unauthorized use of your password or account or any other breach of security,

6.2.2. - ensure that you log out from your account at the end of each session,

6.2.3. - You shall also ensure that you access the Website from an authorized source and connection. Secret Stash cannot and will not be liable for any loss or damage arising from your failure to comply with this Section.

7. Products on Secret Stash

7.1. Secret Stash only accepts Brand New items, Gently Used items, Like New items or Pre-Loved Items. We make sure with the best possible efforts, that the items on our website are authentic and original.

7.2. Items on Secret Stash are always checked for their condition and accordingly are categorized in the conditions listed:-

7.2.1. Brand New,

7.2.2. Gently Used,

7.2.3. Like New,

7.2.4. Pre-Loved Items. (Note- There will never be something that is very beat up for sale on Secret Stash that makes the product unusable.)

8. Facilities available for Users

8.1. Secret Stash provides a number of Internet-based facilities/services through its Website, with the core function of the Website being an online retail platform for pre-owned fashion apparels and accessories.

Users should note the following;

 8.1.1. Pictures and images on our website are for illustration purposes only. For an accurate description of any product and details of what is included with the product, please read the product description.

8.1.2. While we have made every effort to display as accurately as possible the colors of the products that appear on the Site, we cannot guarantee that your monitor or screen’s display of any color will be completely accurate, as computer monitors and screens of electronic devices vary.

8.1.3. When You use the Site or send emails or other data, information or communication to us, You agree and understand that You are communicating with us through electronic records and You consent to receive communications via electronic records from us periodically and as and when required. We will communicate with you by email or by an electronic record on our Site which will be deemed adequate service of notice / electronic record.

8.1.4. Description of the Products. We will take all reasonable care to ensure that all details, descriptions, and prices of products appearing on the website are correct at the time when the relevant information was entered onto the system. Whilst we Endeavour to provide up to date images of individual products, for a minority of items stock images may be used. We reserve the right to refuse orders where product information has been mis-published, including prices and promotions.

Users must note that the Product Description does not act as a warranty and each Product is sold “as is”.

9. Product Availability

9.1. All products are subject to availability and so we may not be able to supply your order. In unforeseen circumstances and with or without notice we may have to stop selling products through Secret Stash either temporarily or permanently.

10. Delivery Terms

10.1. The period of delivery begins at the latest of the following moments:

10.1.1. Date of the order confirmation

10.1.2. Date of fulfillment of all technical, commercial and financial requirements on the part of the buyer

10.1.3. The date on which we received the down payment of the product(s)

10.2. Delivery dates are given in our order confirmation and/or written correspondence are estimated delivery dates and nonbinding otherwise confirmed by us in writing.

10.3. The deadline is met when the Products are declared to be ready for delivery or when the delivery item has left our Location before the delivery period ends. If and in so far the goods fail to be dispatched at the agreed time for reasons not attributable to us, the agreed delivery time shall be considered to have been met at the day on which the goods are notified to be ready for dispatch.

10.4. In the event that we or our suppliers are hindered through an act of God, we are entitled to extend the delivery date by an appropriate period. The same shall apply in the event of government intervention, shortages of energy or raw materials, delays in delivery of components supplied by or on behalf of the buyer, strikes, lockouts, lack of means of transportation and other unforeseen supply problems, insofar as they are beyond our control. We shall inform the buyer without delay and ensure that any inconvenience for the buyer is kept to a minimum, if necessary by releasing the moulds, tools, and devices for the duration of the hindrance.

10.5. We use several couriers to deliver your packages. We choose the best service provider depending upon the buyer’s location.

10.6. We use Third-party delivery service provider and ensures no liability once your Item has been sent to you. You agree not to hold Secret Stash liable in the event of any damage, theft or loss to your product during delivery.  

10.7. Delivery charges vary from customer to customer owing to different locations and Products. Low-value items usually amount to higher shipping cost and vice versa, however, you must note that this may vary for each Product. 

10.8. Orders that are returned to us as undeliverable are not able to be re-shipped and your order is canceled. If you have pre-paid for your order through a Bank transfer, it is your duty to inform us and give us your order number and after investigating we will revert back the payment. If you would still like to purchase items that were undeliverable, you are welcome to place a new order on our website.

11. Additional Terms for Users

11.1. Users have the option to register on our website and create their account by generating their passwords. The User can purchase our Brand New, Like New, Gently Used or Pre Loved goods, (collectively called, “Products" and/or “Items”).

11.2. The Products can be purchased from our website or you may reserve the item by emailing us at info@secretstash.pk or calling us at +92 323 8223055 to pick up and pay at our location, Note: this is valid for Users in Karachi ONLY.

11.3. We offer various methods of payment to the Users including but not limited to:

11.3.1. Cash on Delivery (COD)

11.3.2. Bank Transfer.    

11.3.3. Secret Stash also offers the option to reserve the Product by paying a 20% deposit, which is non-refundable in nature, of the Total price of the Product. Products will not be withheld for the buyer without the deposit. After the deposit is made the Users have a minimum of thirty (30) days and a maximum of sixty (60) days in which they have to complete the rest of the payment. If the payments have not been cleared in the given time the deposit will be not be refunded. Deposits will not be transferred from one Product to another. In addition, Products will not be shipped or available for a pick up until the total amount has been transferred to Secret Stash. Users must keep in mind that once they have made a deposit for a Product you have fully committed to buying that Product and in also to clear the payment in the given time. 

11.4. The Buying Process

11.4.1. As a User, you can select any item you wish to purchase and add it to your cart. Once it gets added to your cart you can check out immediately. You can pay by Bank transfer, Cash on Delivery, or requesting an appointment at our store for a private viewing of the product.

If you select a COD (Cash on delivery) method of payment, if applicable to your address pin code, the order will be placed but will not be confirmed immediately. You may first receive a confirmation call from our side seeking further details from you if needed. However, if you prepay (Bank Transfer) for the item your order would be confirmed immediately once payment is received by Us, you shall receive an email or SMS confirmation or from Facebook Messenger from our side of the order placed by you. You are requested to quote the same order number for any future communications between us and we shall also do the same. Before opting for COD, Buyers are requested to check for COD availability for their location.

11.4.2. The User recognizes that all the Products on Secret Stash are checked for authentication in-house and the authentication process is independent of any brand association of any sort, furthermore the brands that are mentioned on Secret Stash are not involved in the authentication process as Secret Stash holds no formal association with any of them. None of the Brand owners or sellers takes any responsibility for any of the Products that are purchased through Secret Stash. 

11.5. Product Pricing

11.5.1. Our Prices are set taking into consideration the product(s) approximate original price, its brand profile, its condition based on how it has been used and maintained, its fashion quotient and its current market demand. Prices and availability of the Product(s) are subject to change without any prior notice. The prices mentioned on the website are not subject to comparison with the same or any similar product(s) and/or service(s) available through any online sale. The pricing is subject to our pricing policy and the prices shall be determined at our sole discretion. While we strive to provide accurate product and pricing information, an inadvertent mistake or typographical errors may occur. In the event that a product is listed at an incorrect price or with incorrect information due to an error in pricing or product information, we may, at our discretion, either contact you for instructions or cancel your order and notify you of such cancellation. We will have the right to modify the price of the product and contact you for further instructions using the e-mail address or telephone number provided by you during the time of registration, or cancel the order and notify you of such cancellation.

11.6. Cancellations made by Secret Stash

11.6.1. Please note that there may be certain orders that we are unable to accept and must cancel. We reserve the right, at our sole discretion, to refuse or cancel any order for any reason. Some situations that may result in your order being canceled shall include limitations on quantities available, inaccuracies or errors in product(s) or pricing information, or any defect regarding the quality of the product(s) or any questions related to authentication. We may also require additional verification's or information before accepting any order. We will contact you if all or any portion of your order is canceled or if additional information is required to accept your order. If your order is canceled after you have made the bank transfer, the said amount will be reversed back to you through the same payment method as utilized by you. In-case of Cash on Delivery (COD), we hold the right to cancel the order if no verbal or written confirmation is made within 2 calendar days by us after your placing the order at the website.

11.7. Cancellations made by the User

11.7.1. In case of requests for order cancellations, we reserve the right to accept or reject requests for order cancellations for any reason. As part of usual business practice, if we receive a cancellation notice and the order has not been processed by us, we shall cancel the order and refund the entire amount. A request for cancellation of an order shall be valid and accepted only till the order has not been shipped. The User agrees not to dispute the decision made by us and accepts our decision regarding the cancellation. Frequent cancellations by any particular User opting COD basis of payment may compel us to bar/blacklist the said User from using the COD option of payment and our decision would stand final.

11.8. Returns or Exchange

11.8.1. We do not accept goods for Return or Exchange. All sales on Secret Stash are deemed to be final.

12. Additional Terms for Sellers

12.1. Sellers may send us Brand New, Gently Used, Like New and Pre-loved,  Products to us. We accept items from Designers and/or High street brands only. Please note that Secret Stash makes no claims, affiliations, partnerships etc with any of the Brands on their website.

12.2. Sellers are prohibited to use Secret Stash for the activities listed:

12.2.1. Selling illegal, stolen, counterfeit or designer knockoffs (items that are fakes, inauthentic, stolen, illegally obtained or not manufactured by the designer whose name, logo, trademark, or design is represented in or on the item);

12.2.2. Using any information obtained from the website in order to contact, advertise, solicit, or sell to any other user without prior explicit consent;

12.2.3. Engaging in any automated use of the systems, such as using scripts to add friends or send comments or messages;

12.3. Sellers Compliance

12.3.1. By agreeing to send your Product for sale on SecretStash.pk you warrant that you shall comply with Secret Stash’s Terms and Conditions, Privacy Policy and policies published from time to time. You also warrant that you are the owner to legally sell the item.   

12.4. Binding Sale

12.4.1. All sales are binding. Once the item has been approved & uploaded on Secret Stash, the sellers cannot then demand that they wish to retract the offer and rescind the offer to sell.

12.5. Selling terms

12.5.1. Our goal is to sell your product quickly while bringing the best value within the pre-owned market. The Seller makes their product(s) available to Secret Stash. The Seller will ensure that the products are insured from all risks of fire, accidental damage or breakage, any acts of nature resulting or any damage to the products until the products are delivered to Secret Stash at the contracted shipping address. The Seller retains all risk of loss or damage to the Property while the Property is in transit. All risk of loss or damage of the Product(s) will pass to Secret Stash only when the Product(s) are in Secret Stash’s physical possession.

12.5.2. If the Product does not sell in the given period, it will be shipped back to the seller and the shipping cost will be borne by the seller.

12.5.3. When you send us your Product, Secret Stash holds the Product in Storage at their registered office until the product is sold or shipped back to the Seller. When Secret Stash receives your Product, Secret Stash confirms the condition they have received the Product in. Kindly note, that sometimes during storage the Product may show signs of natural depreciation and weathering because of prolonged storage due to Product not being sold. It is the duty of the Seller to provide proper packaging and covering for their Products that they send to Secret Stash to sell. The seller agrees to indemnify Secret Stash in such situations.

12.5.4. It is the Sellers duty to check the pockets or any sort of storage compartments and remove any personal belongings or items not part of the Product before shipping them to Secret Stash. Secret Stash will not be liable for any personal belongings contained in the Pockets or any sort of storage compartment of the Product. 

12.5.5. While the Product is on sale on Secret Stash you agree to not advertise the Product on any other platform or website, in addition, you shall not recall the Product for a period of thirty (30) days.

12.5.6.   Secret Stash will inform you If your Product is not sold within the given time period. After being informed it is the Sellers responsibility to revert back within thirty (30) days, if Secret Stash does not hear back from the seller within thirty (30) days, Secret Stash reserves the right to dispose of the Product as we deem fit.

12.5.7. It is the Sellers responsibility to ensure that they state their correct contact information, including but not limited to, Name, Contact Number, Address etc when they Ship the Product to Secret Stash. The Contact information must be the same as the previous communications that you have carried out with us. This is so Secret Stash can easily identify the Product with its Seller.

12.6. Acceptance, condition, and Authentication of Product

12.6.1. Secret Stash only accepts items of a certain standard i.e. reasonably good to excellent condition or brand new. Upon receipt, we evaluate the product to determine its condition authenticity and quality. The Seller attests to the authenticity of all agreed upon items and confirms that they have not knowingly attempted to resell counterfeit products to Secret Stash. Products deemed to be counterfeit will be returned to the Seller with the charges of authentication, shipping costs and also it will terminate the contract between the Seller and Secret Stash. Items that do not meet our authenticity or quality standards, will not be accepted and will be returned to Seller at cost.

12.6.2. Product conditions that we accept are listed as follows;

1. Authentic Brand Products,
2. Products in good condition without any tear or damage,

• Products without any stains or marks of any kind,

1. Products in their original shape and size,
2. Products with their original colors intact,
3. Products which have been washed or are clean.

12.6.3. Our Reasons for not approving products are, including but not limited to;

1. Fakes or Replicas,
2. Stained or marked of any kind,
3. Unclean/unwashed/foul-smelling,
4. Visible Wear, tear, holes, loose threads in the product,
5. Defective/Damaged,
6. Altered in any way,
7. Authenticity is not verifiable or is unclear,
8. Discoloration,
9. Loss of Shape or where the fabric has been overstretched or has shrunk,
10. Products with missing essentials, including but not limited to, zippers, buttons, sequins, embroidery, missing stones etc.

12.7. Selling and Pricing

12.7.1. Upon acceptance of the Product, Secret Stash will display and make commercially reasonable efforts to sell the Product at the agreed Prices. Extensive efforts are put to sell the product like Quality Checks, Photo Shoots, and Hygiene process and media advertisements. Secret Stash would endeavor to list as many of Sellers Product as possible provided it meets its overall quality standards. Therefore, Secret Stash may try and rectify any minor stain defects in the Product at its discretion through the sanitization process. However, in doing so, if the Product gets inadvertently/accidentally damaged in the process, Secret Stash would not be held responsible. 

12.7.2. The Seller acknowledges and agrees that Secret Stash will display all attributes of the sold product(s) in the manner it deems fit. The price of an approved Product is defined by Secret Stash and agreed to by the seller, the price cannot be higher than the original price of the Product, the bigger the discount higher the probability that it will sell, Secret Stash reserves the right to retain the product for minimum ninety (90) days from date of listing on the website and discount it as required over the retention period. The Site reserves the right to run promotions on its website and by other means and to offer cash or trade discounts to its buyers/customers at its sole discretion. The Seller acknowledges and agrees that Products may be advertised, displayed and sold with items belonging to other Sellers. In case of no sale within the agreed retention period of the product, several efforts can be put for the products promotion, which may include reduction of price, if agreed to by the Seller.

12.7.3. The Seller acknowledges and agrees that the pricing of the product(s) will be set taking into consideration the product(s) approximate original price, its brand profile, its condition based on how it has been used & maintained, its fashion quotient, its seasonal application and its current market demand.

12.7.4. Once the Product is sold, Secret Stash holds a 25% commission from the Price that the Product is Sold for. 

12.7.5. Secret Stash will only pay the seller once the Item has been sold and Secret Stash has received the payments in total. After 30days Secret Stash will contact you and clear your payment for your Products that are sold and in case of Products that are not sold Secret Stash will inform you with the next steps forward.  When you agree to sell on Secret Stash you hereby agree to pay the 25% commission to Secret Stash for selling your Product.

12.8. Title of the Product

12.8.1. The Seller attests that they have the legal title to all the products sent by them to Secret Stash. Please note Shipment does not mean sale of the product. The Seller legally gives the rights to Secret Stash to sell their Product. The legal ownership of the product is transferred to Secret Stash only on the day the product is accepted by the buyer of Secret Stash. Please note that in case of no sale in the agreed Shipment period, Secret Stash may extend the period for a further period as agreed with the Seller or give an option to the Seller to either call back the product.

13. Intellectual Property Rights

13.1. In consideration of you agreeing to abide by these Terms, Secret Stash grants you a non-transferable, non-exclusive license to use our website on the Device, subject to these terms, the Privacy Policy and any other applicable rules. Secret Stash reserves all other rights.

13.2. You may download or stream a copy of the website onto your Device, to view, use and display the website on the Device for your personal purposes only.

13.3. You acknowledge that all Intellectual Property Rights on the website anywhere in the world belong to Secret Stash or its licensors, that rights on the Website are licensed (not sold) to you, and that you have no rights in, or to, the website, other than the right to use it in accordance with these Terms. You acknowledge that you have no right to have access to the website in source-code form.

13.4. Unless otherwise indicated or anything contained to the contrary or any proprietary material owned by a third party and so expressly mentioned, Secret Stash owns all Intellectual Property Rights to and into the Website, including, without limitation, any and all rights, title and interest in and to copyright, related rights, patents, utility models, trademarks, trade names, service marks, designs, know-how, trade secrets and inventions (whether patentable or not), goodwill, source code, meta tags, databases, text, content, graphics, icons, and hyperlinks. You acknowledge and agree that you shall not use, reproduce or distribute any content from the Website belonging to Secret Stash.  

14. Trademarks and Copyrights

14.1. All intellectual property rights, whether registered or unregistered, in the Site, information content on the Site and all the website design, including, but not limited to text, graphics, software, photos, video, music, sound, and their selection and arrangement, and all software compilations, underlying source code, and software shall remain our property. The entire contents of the Site also are protected by copyright as a collective work under Pakistani copyright laws and international conventions. All rights are reserved.

15. Termination of Users who Infringe the Copyright or Other Intellectual Property Rights of Others

15.1. Secret Stash and its affiliated companies respect the intellectual property of others, and we ask our users, account holders and content partners to do the same. The unauthorized reproduction, copying, distribution, modification, public display or public performance of copyrighted works constitutes infringement of the copyright owners’ rights. As a condition of your use of Secret Stash, You agree not to use Secret Stash to infringe the intellectual property rights of others in any way, directly or indirectly. We at our sole discretion will terminate the accounts of any Secret Stash account holders, and block access to Secret Stash of any Users who to the knowledge of Secret Stash are infringers of the copyrights, or other intellectual property rights, of others. We reserve the right to take these actions at any time, in our sole discretion, with or without notice, and without any liability to the account holder who is terminated or to the User whose access is blocked. Notwithstanding the foregoing, in the event that You believe in good faith that a notice of copyright infringement has been wrongly filed against You or your copyrighted work that has been uploaded, posted or copied to our website and is accessible on such Secret Stash in a way that constitutes copyright infringement, please contact us under info@secretstash.pk

16.4. In the event that your name, address, and phone number are passed on to a third party, this will only happen in an effort to have your order delivered to you. When you place an order through Secret Stash, your personal information will also be automatically used for marketing and/or promotional purposes from time to time. However, you can choose to not receive marketing or promotional information from Secret Stash at any time by simply utilizing the unsubscribe function in the electronic marketing material sent to you.

16.5. In the event that we engage with third party service providers in connection with our Services, we may share Personal Information with such service providers who need access to such information to carry out their work for us. Any such termination or suspension shall be made by us in our sole discretion, without any refund to you of any prepaid fees or amounts, and we will not be responsible to you or any third party for any damages that may result or arise out of such termination or suspension of your account and/or access to Secret Stash. 24. Severability

24.1. In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

25. Other Important Terms

25.1 Secret Stash may transfer its rights and obligations under these Terms to another organization, and will always notify you in writing if this happens, but this will not affect your rights or its obligations under these Terms.

25.2. You may only transfer your rights or your obligations under these Terms to another person if We agree in writing.

25.3. This contract is between you and Us. No other person shall have any rights to enforce any of its terms under the Contracts (Rights of Third Parties) Act.

25.4. Each of the paragraphs of these Terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.

25.5. If Secret Stash fails to insist that you perform any of your obligations under these Terms, or if it does not enforce its rights against you, or if it delays in doing so, that will not mean that it has waived its rights against you and will not mean that you do not have to comply with those obligations. If Secret Stash does waive a default by you, it will only do so in writing, and that will not mean that it will automatically waive any later default by you.

26. General

26.1. ASSIGNMENT:  You may not assign or sub-license the rights, duties or obligations under the Terms of Use, in whole or in part, to any person or entity without the prior written of Secret Stash.

26.3. GOVERNING LAW AND JURISDICTION: Any disputes arising between You and Secret Stash is to be governed by and construed in accordance with the laws of Pakistan

26.4. SEVERABILITY AND WAIVER: If any provisions of these Terms of Use are found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms of Use, which shall remain in full force and effect. No waiver of any term of these Terms of Use shall be deemed a further or continuing waiver of such term or any other term.

26.5. ENTIRE AGREEMENT: The Terms of Use including the Secret Stash Privacy Policy constitute the entire agreement between You and Secret Stash.
